Deposits are non-refundable once work has commenced.
Completed work is non-refundable.
Monthly marketing retainers are non-refundable.
Advertising budgets paid to third-party platforms are non-refundable.
Refund requests are reviewed solely at RDM Media’s discretion.

7. Client Responsibilities

Clients agree to:

Provide accurate information.
Supply required content promptly.
Approve designs and deliverables within agreed timelines.
Obtain necessary rights for any materials supplied.
Review completed work before publication.

Project delays caused by missing client information may result in revised delivery schedules.

8. Intellectual Property

Unless otherwise agreed:

Final deliverables become the client’s property upon full payment.
RDM Media retains ownership of internal processes, templates, methodologies, source files, AI workflows, and proprietary tools.
Draft concepts remain the property of RDM Media unless purchased.

9. Portfolio Rights

Unless restricted by a written NDA, RDM Media reserves the right to display completed work in:

Portfolio
Website
Social media
Marketing materials
Awards submissions
Case studies

10. Confidentiality

Both parties agree to keep confidential information private.

This includes:

Business plans
Marketing strategies
Financial information
Customer data
Login credentials
Proprietary documents

Confidentiality obligations survive project completion.

We are not responsible for:

Platform outages

SEO rankings cannot be guaranteed.

Search engine algorithms constantly change.

RDM Media will use industry best practices but does not guarantee:

Sales increases

13. Advertising Disclaimer

Advertising performance depends on many factors including:

Competition
Budget
Target audience
Product quality

RDM Media cannot guarantee:

Sales
Leads
Return on investment (ROI)

14. Website Hosting

Where hosting is provided:

Clients are responsible for timely renewal payments.
Failure to renew may result in suspension or deletion by the hosting provider.
RDM Media is not responsible for data loss caused by third-party hosting providers.

15. Domain Names

If RDM Media registers a domain:

Ownership transfers upon full payment if agreed.
Renewal fees remain the client’s responsibility.
Failure to renew may result in domain expiration.

16. AI-Generated Content

Some deliverables may involve AI-assisted tools.

Clients acknowledge that:

AI content may require human review.
Clients are responsible for verifying factual accuracy before publication.
AI-generated content may not always be unique or error-free.

17. Limitation of Liability

To the fullest extent permitted by law, RDM Media shall not be liable for:

Lost profits
Business interruption
Loss of data
Indirect damages
Consequential damages
Special damages

Our maximum liability shall not exceed the total fees paid by the client for the affected project.

18. Indemnification

Clients agree to indemnify and hold harmless RDM Media from claims arising from:

Copyright infringement caused by client-provided materials
Trademark disputes
Defamatory content
Illegal business activities
Unauthorized use of third-party content

19. Termination

Either party may terminate services by written notice.

Outstanding invoices remain payable.

RDM Media reserves the right to terminate services immediately if a client:

Violates these Terms
Engages in abusive conduct
Requests unlawful activities
Fails to pay invoices

20. Force Majeure

RDM Media shall not be liable for delays caused by events beyond reasonable control, including:

Natural disasters
Internet outages
Government actions
Pandemics
Cyberattacks
Labour disputes
